Kalkine Canada Advisory Services Inc. (“Kalkine”, “we”, “our”, “us”) prioritizes privacy, trust, support, and reliability. Using the Internet poses threats to the security and privacy of everyone involved.  

In this privacy policy, those who create an account on the Website are called “Members”. In this privacy policy, users of the Services, whether they are Members or casual browsers of the Website, are called “Users” or “you”.

1)        Personal Information

“Personal Information” means information that: (a) can identify an individual directly; or (b) is information about an identifiable individual, whether that information or opinion is true or not or recorded in a material form or not, but does not include business contact information that is used solely for the purpose of communicating or facilitating communication with an individual in relation to their employment, business, or profession.

2)       Agreeing to the Terms of our Privacy Policy

By accessing and or using the Services, or by registering as a Member, you agree to the terms in this Privacy Policy, meaning you expressly consent to our information handling practices in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms and Conditions (the “Terms and Conditions”).

Providing Personal Information or authorizing a third party to disclose Personal Information to us signifies your consent to Kalkine’s collection, use, and disclosure of Personal Information in accordance with this Privacy Policy.

You have the right to withdraw your consent from us collecting and using your Personal Information, but this may limit our ability to provide you with our Services, if applicable.

3)       What Personal Information is Collected?

The primary purpose for our collection of Personal Information is to provide the Services and features expected from us by our Users. We only collect Personal Information about you that we consider necessary for achieving the normal operation of our Services.

The type of Personal Information that may be collected includes, but is not limited to:

• Contact information: this information allows us to identify you as well as send you materials. It lets us communicate with you regarding instructions and requests. Typical contact information we may collect includes name, email address, mailing address, and phone number;
• Payment information: we use credit card and other payment information you submit to us on the Services to process payments you make. We do not store credit card or other payment method information;
• Marketing and communications information includes communication preferences and your preferences in receiving marketing from us and third parties;
• Profile information: includes your username and password, purchases or orders made by you, your interests, preferences (such as product wish lists and order history), feedback, and survey responses;
• Computer information: this includes information like device type, device identifier, IP address, MAC address, location, browser type, operating system, duration of use, user behaviour, length of time spent on the services, and frequency of use; and
• Other information you voluntarily provide to us, our employees, or our contractors.

4)        How Do We Collect Personal Information?

Personal Information may be collected in a number of ways, including through our Services, in person, by mail, and by email. We collect your information when you place an order with us or when you contact us. When you place an order to purchase a Service, we provide a secure (Secure Sockets Layer, encrypted) connection and require you to submit only the information needed to complete and fulfil your order. Only our authorized employees will have access to Personal Information relating to a purchase of Services.

In general, you can browse the Website without telling us who you are or revealing any Personal Information about yourself. Once you become a Member, we require certain Personal Information from you in order to fulfill Service features and functionality, verify your identity, and provide a safe experience. Personal Information collected includes, but is not limited to, identifying information, contact information, billing information, preferences and settings, and other attributes that will be indicated to you at the time of collection.

You do not have to use the Services if you do not want to disclose your Personal Information. You have the right to refuse providing us with Personal Information by disengaging from the feature or offering that is making the request. By choosing not to become a Member, and by not engaging with any offerings wherein information is specifically requested, we consider you an anonymous User.

We conduct banner advertising on various websites where individuals can input certain Personal Information, such as their first name, last name, e-mail address, and phone number (“Banner Advertising”). Information collected through Banner Advertising is used to generate sales and gather marketing information. Our sales team makes direct telephone calls with the objective of making sales to individuals who have shown their interest in our Services through Banner Advertising. We call our existing Members who pay for Services to promote re-subscription to our Services. By submitting their Personal Information, an individual agrees to our marketing and sales initiatives.

We automatically gather information about your navigational behaviour and your computer, such as your IP address, your device and browser information, referring/exit pages, and operating system. We only use this information for internal research to better understand the needs and interests of our visitors, assess our growth, get insight on demographics, and improve the overall quality and integrity of our community. Information can be obtained through one of the following ways:

• Cookies

Cookies are small files placed on your computer by a web page when you visit it (“Cookies”). Cookies are small files stored on your device through your browser, and the data kept in them can be retrieved from a website you are visiting in order to remember something about you on a subsequent visit. The Services only use Cookies to compile statistics on the use of the Services (such as statistics relating to the popularity of various pages on our Website). We do not store or collect any personally identifiable information.

You may refuse to accept Cookies by activating the setting on your browser which allows you to refuse the setting of Cookies. However, if you select this setting, you may be unable to access certain parts of our Services. By accepting Cookies and continuing to visit or use our Website, you are agreeing to the use of Cookies and similar technologies for the purposes we describe in this Privacy Policy.

• Web Beacon

When we send you emails, we may include a web beacon to allow us to determine the number of people who open our emails (a “Web Beacon”). When you click on a link in an email, we may record this individual response to allow us to customize our offerings to you. A Web Beacon only collects limited information, such as a Cookie identifier, time, date of a page being viewed, and a description of the page on which the Web Beacon resides.

Web Beacons can be refused when delivered through email. If you do not wish to receive Web Beacons through email, you will need to disable HTML images or refuse HTML (select “Text Only”) emails through your email software.

• Third-party metrics and analytics

We use third-party metric and analytic services on certain pages or features of the Services to help us understand and analyse visitor traffic, measure the promotional effectiveness and efficacy of our features, offerings, and marketing campaigns. We also use these tools to identify pitfalls, shortcomings, and areas of our operations in need of improvement, and to view the overall performance and ranking of our online presence. These tools might store Cookies on your device at their discretion. We sometimes use surveys or other forms provided by a third party. It is possible that when engaged, the third-party provider might collect information or store a Cookie. We never explicitly provide information that we have collected about you to any third-parties. • Obtain feedback, respond to customer service requests, questions, and concerns: on occasion we use email addresses or other contact information to contact our Members to ask them for their input on our Services;

• Send you a newsletter and or marketing communications: to improve our marketing and promotional efforts, to analyze Service usage, to improve our content and product offerings, and to customize the Website’s content, layout, and Services. Doing so helps us improve the Services and better tailor the Services to meet your needs, in order to provide you with a smooth, efficient, safe, and customized experience while using the Services. We may also administer surveys, contests, draws, raffles, offer tailored content, and other promotional materials to you based on your interests;
• Improve our Website: to administer and protect our business and the Services, including troubleshooting, data analysis, testing, system maintenance, support, reporting, and hosting of data;
• Use the services of subsidiaries, affiliates, and service providers: we may from time to time use the services of affiliates, subsidiaries, and unrelated service providers in the operation of the Services, and may disclose personal information to them in the course of our use of their services. For example, we may use the services of third-party hosting companies to host the operation of the Website. This may involve the hosting of data, including Personal Information, on servers operated by those hosting companies. We take care to use only service providers that we believe are reputable and able to live up to our and your expectations, including about the handling of confidential information;

• To comply with our regulatory and legal obligations and protect our legal rights, including, and without limitation, to comply with recordkeeping and reporting.

6)        Who Can Access My Personal Information?

Only Kalkine’s authorized employees have access to the information you provide. Kalkine may disclose your Personal Information: (a) to any governmental authority as part of an investigation to determine our compliance with any applicable law, rule, or regulation (including privacy laws, rules, and regulations); (b) in response to a court order, subpoena, discovery request, or other lawful judicial or administrative proceeding; (c) as otherwise required under any applicable law, rule, or regulation; and (d) in good faith, to protect or defend the rights or property of Kalkine and other persons. We may be required to share your Personal Information without your consent where required or permitted at law. In limited circumstances, we may be legally prohibited from advising you that your information was shared in this way.

We may also, if necessary, provide your Personal Information to our lawyers, accountants, auditors, and other third parties (such as but not limited to technology providers) who provide services to us or act on our behalf, for the purposes of giving effect to our Services.

7)            Disclosures Outside Canada

Kalkine, being a global company has affiliates and service providers around the world. We may share your information outside Canada with other service providers or third-parties including Kalkine’s affiliates/business units in Australia, the UK, India, New Zealand, and the USA (collectively, the “Affiliates and Related Parties”) for purposes of providing services to you. 

We use contractual and other measures to ensure these Affiliates and Related Parties protect your Personal Information in accordance with the terms of our Privacy Policy to ensure that the Personal Information is used for the same purposes for which we are authorized to use the Personal Information.

Personal information provided to our service providers may be stored outside the Province of Ontario and outside of Canada. You acknowledge and agree that, as a result, your personal information may be processed, used, stored or accessed in other jurisdictions and may be subject to the laws of those jurisdictions. For example, information may be disclosed in response to valid demands or requests from government authorities, courts, or law enforcement in other countries.

8)          Consent for Marketing Purposes

By subscribing to a Kalkine Service, you consent to receive: (a) news and offers related to your subscribed Services; and (b) news and offers from Kalkine or other related companies that may suit your interests. On occasion, Kalkine may use your mailing address for direct marketing purposes. If at any time you do not want your mailing address to be used for direct marketing, or to receive news and offers from carefully selected organizations, please contact us directly by email, post, or phone. Kalkine newsletters, updates, and special reports are sent electronically. If you no longer wish to receive these services, you may cancel your subscription at any time.

Once you provide us with information, the Affiliates and Related Parties may use your information including for marketing purposes, pursuant to the terms of this Privacy Policy. Kalkine may also allow banner advertising for the Affiliates and Related Parties, the contents of such advertising will be governed by their respective terms and conditions, privacy policy, disclaimers, and other affiliated documents. We will never share or sell your email address to third parties for marketing purposes. We may occasionally send you advertisements, but they will be in accordance with your selected preferences.

Our email marketing is permission based. If you received mail from Kalkine, it is because you have a subscription to a Service or have consented to the terms of this Privacy Policy. You may unsubscribe at any time by mail, by phone, or by clicking the unsubscribe link at the bottom of each email.

9)             International Visitors

Kalkine’s Services are hosted in Canada and are intended for visitors located within Canada. If you choose to use the Services from other regions of the world with laws governing data collection and use that may differ from Canadian law, please note that you are transferring your Personal Information outside of those regions to Canada for storage and processing. We may transfer your data from Canada to other countries or regions in connection with the storage and processing of data, fulfilling your requests, and operating the services. By providing any information through the Services, including Personal Information, you consent to such transfer, storage, and processing.

If you are doing business with a related Kalkine entity in another jurisdiction, such as Australia, the USA, India, New Zealand, or the UK, your interactions with that Kalkine entity will be governed by the applicable privacy policy for that jurisdiction. 10)          Making Changes to Your Account

Members can review and change their Personal Information, as well as close their account at any time. To review and update your Personal Information to ensure it is accurate, you may log in to your account to make the changes, or you may contact us at [email protected].

11)             Opting Out

If you wish to no longer receive our newsletters, marketing communications or other communications that are not reasonably necessary to provide you with the Services, you may unsubscribe at any time (we provide you a way to unsubscribe in any email correspondence) or you may contact us at [email protected].  If you wish to unsubscribe to communications that are reasonably necessary to provide the Service, we may either be limited in our ability to unsubscribe you from those communications, or we may not be able to provide you with those Services.

12)          Account Deletion

When a Member’s subscription expires, or you have opted out of the subscriptions and unsubscribe from mailers, we will remove your information from our marketing and billing systems. This will ensure that there are no further mailings or billings directed towards the cancelled Member.

Furthermore, if you wish to have us delete all your data held on our servers, please contact us at [email protected]. We will ensure to remove all data without breaking accepted accounting principles.

13)          Personal Information and Data Security

Kalkine makes reasonable efforts to ensure the security of Personal Information on our system. Despite security measures, online storage and online communications are not entirely secure. We encourage all individuals to provide only the information they are comfortable with providing a third party, keep watch for communications that are suspicious, and report any suspicious activity to us as soon as possible.

Kalkine uses reasonable efforts to ensure all data collected, including Personal Information, is protected and secure against unauthorised access, alteration, or deletion. Any data you submit to us through an online order form is transferred to us through a Secure Sockets Layer – an encryption protocol – and is kept in databases that cannot be accessed from outside our firewall. Our firewall is a mechanism that prevents access to our servers by anyone outside of the company.

The Services and e-mails may contain links to third-party websites. Should you choose to click these links please be aware that our privacy policy will no longer apply. Please read and understand the privacy policy of the third-party website before continuing further.

14)            Your Rights

You may contact us to ask what information we have about you. Before you can obtain access to any information held by Kalkine about you, your identity will first need to be verified. If you inquire about one of your subscriptions to our Services, we may ask you to confirm information you have already given us.  You may contact us to ask what information we have about you. You can ask us to:

• Provide a copy of your Personal Information;
• Correct your Personal Information;
• Erase your Personal Information. Please note that we will only honour such requests where this policy otherwise permits us to do so; and
• Restrict the processing of your Personal Information.

This Privacy Policy and all related matters shall be interpreted and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.
